Acceptance of Terms & Conditions
The following are the terms on which we offer you to access our site and services. These Terms & Conditions. If you wish to use the Talent Talks Ltd website in any way either as a member, a non member or any other associated membership on any type of subscription or using any type of profile, you agree to be bound by these Terms & Conditions. If you object to any part of these Terms & Conditions, please do not use the Talent Talks website.
Changes to Terms & Conditions
We may change the terms and conditions from time to time. Changes will be effective immediately upon us updating the terms and conditions on this web site. It is important that you are responsible for ensuring you are up to date with the latest terms and conditions. These Terms & Conditions were last updated in February 2014.
Talent Talks Ltd operates a casting website whereby advertisers may choose to place advertisements. Applicants such as models, actors, dancers and applicants seeking casting calls within the entertainment industry may choose to apply to such advertisements, at which point Talent Talks Ltd will forward the applicant's details to the advertiser or display further application instructions.
Talent Talks Ltd is not responsible for the content and makes no guarantees as to the accuracy of the advertisements. We will always check out jobs the best we can but members should always use their own judgement in deciding whether or not to apply for any roles advertised on the Talent Talks website. We provide our service only for the purposes of providing listings for casting and auditions with third party advertisers. We shall not be liable under any circumstances for the actions of any advertiser of any role featured on this site.
The fees payable in respect of the Service shall be those fees as set out on the website from time to time. We reserve the right to vary the fees in accordance with these terms and conditions.
Price and Subscription Costs
We reserve the right to increase fees or introduce new prices or charges at any time. The correct fees are the ones stated on the website at this time. If you feel there is an anomaly, please contact firstname.lastname@example.org. If you select the monthly payment, your account will be debited the monthly cost on the said day each month. If this date falls on a Public Holiday, the payment may be taken on the last working day before the payment date. The monthly payment will continue to be taken until cancellation is made with the required written notice. If initial payment is made on a numerical date that doesn’t exist, for example on the 31st January, whereby there is not a 31st February, payment will be made on the next proceeding payment day. In this instance payment will be made on 28th February.
By selecting the 6 monthly or annual upfront payment you will have access to all Talent Talks job roles for the agreed period. Upon anniversary, you will not automatically be debited for a further period. We will email you to inform you that your subscription has ended. If you want to rejoin, you will need to make a payment via ‘My Account’ or ‘Edit Account’.
If you have been booked on a shoot with Talent Talks, unless there is a prior agreement with the Production Company, Talent Talks will pay you. Talent Talks will invoice the Production Company on behalf of all that was on the shoot once the shoot has finished. Once payment is cleared we will make back to back transfer to you. Our invoices indicate a 31 day payment term to the Production Company. Occasionally, client payments are delayed in which case your payment will similarly be belated. We are in constant contact with clients and will update you on the progress with any relevant information.
The payment amount made by Talent Talks to you will be given to you prior to the shoot. This will be confirmed on email or will be shown in the job post. This figure will NOT be subject to any commission. The payment you a told is the payment you will receive.
Occasionally on set you will be asked to sign a release form. It might be the case that the figure shown on the release form is different to the amount being paid to you. The reason for this is that for budgetary reasons on behalf of the Production Company, it may be that the client needs to add our agency fee in to your fee. See F&Q’s for further explanation.
If payment is not made by a client for whatever reason including those of going in to liquidation or administration, Talent Talks is not responsible to pay you for any money owed. In such an event, Talent Talks will endeavour to recover the money wherever possible. Talent Talks does however only work with established Production Companies and clients and the likelihood of this is extremely low.
Tax Returns & HMRC
By subscribing to any of the Talent Talks Membership Packages or by being placed on a paid shoot via Talent Talks, you are not considered to be an ‘Employee’ of the Company and subsequent Payment for Castings attended are not taxed before you receive them.
If you have tax to pay on any payments made by Talent Talks Limited (that is, you have income on which tax – or more tax – is due) and you do not normally get sent a tax return or notice to file on-line, then it is your responsibility to tell HMRC of any new sources of income. This is so that HMRC can issue you with a tax return in good time for you to meet the filing deadlines, if they decide that a return is needed.
If you wish to end your membership with Talent Talks Ltd, please write to us at the address on the ‘Contact Us’ page. We would appreciate if you could detail to us why you want to cancel. This will help us improve our services for other members. Your account will be ceased after 7 working days. To avoid being charged for that particular month, your written request will need to be with us 7 working days prior to when the next Direct Debt is due. You do not need to write to us if you have cancelled your Paypal payment or are on a 6, 12 or any other multi-month agreement.
When signing up with Talent Talks Ltd, your profile will be viewable to yourself under your Log In. Employers of Talent Talks Ltd also have access to your account and may change one or two things to enhance it. Talent Talks agents and Talent Talks partners including casting agencies who have access to our Talent Directory in order to hand pick for particular roles also have access to viewing your profile.
Sharing your content and information
Any information submitted by you through the site may be read and used by Talent Talks Ltd and utilised for marketing purposes indefinitely. Your material may appear in internet search engines.
Breach or Termination of account
Talent Talks reserve the right to terminate any users of the Talent Talks website without reimbursement if we deem your behaviour detrimental to the interests of Talent Talks. Talent Talks operates a ‘3 Strike Ruling’ on minor offences; please see FAQ’s for full details on this rule..
Talent Talks Ltd actively search for Partners with an aim of bringing more benefit to our members. Your information may be shared with them to offer you goods and services exclusive to Talent Talks members. Any promotions / vouchers / services that you purchase through Talent Talks Ltd with any of our partners is subject to it’s individual Terms & Conditions but will be listed at the time of purchase.
We will not sell or allow non Partner third parties to access your personal information without your consent, however you agree that Talent Talks Ltd may disclose your personal information, including your name and contact details, to the relevant authorities, parties and/or the applicable intellectual property right holders (or their representatives) where the law requires us to do so.
